If the hotel accepts a special agreement within the scope of laws and customs, the special agreement shall take precedence regardless of the provisions of the preceding paragraph.

Application for accommodation contract

A person who intends to apply for an accommodation contract with the hotel shall notify the hotel of the following particulars:

Establishment of accommodation contract, etc.

An accommodation contract shall be deemed to have been concluded when the hotel has accepted the application as stipulated in the preceding article.However, this does not apply when it is proved that the hotel did not accept it.In addition, when making a reservation via the Internet, when the fact that the hotel accepts the application set forth in the preceding article is displayed on the URL of the reservation reception site of the hotel (hereinafter referred to as this site) on the Internet, or It shall be established when the e-mail to that effect reaches the server that manages the e-mail address specified by the customer.

When an accommodation contract has been concluded in accordance with the provisions of the preceding paragraph, the application fee determined by the hotel up to the basic accommodation fee for the period of stay (XNUMX days if it exceeds XNUMX days) must be paid by the date specified by the hotel. .

The deposit shall first be applied to the final accommodation charge to be paid by the guest, and in the event of a situation requiring provision of the provisions of Article 18 and Article 12, the deposit shall be applied in the order of cancellation charges and then compensation. , If there is any remaining balance, it will be refunded at the time of payment of charges as stipulated in Article XNUMX.

If the application fee in Paragraph XNUMX is not paid by the date specified by the hotel in accordance with the provisions of the same paragraph, the accommodation contract will become invalid.However, this is limited to cases where the hotel notifies the guest to that effect when specifying the due date for payment of the deposit.

In the event that the Hotel presents an incorrect accommodation charge on the Internet site or informs of an incorrect accommodation charge over the phone, an application for an accommodation contract is made based on the said accommodation charge, and the Hotel accepts it, the said charge will not be refunded. If the price is remarkably lower than the accommodation charges for the preceding and following dates, unless the reason for the lower price is indicated or provided, such as "limited", "special", or "campaign", it is a mistake under the Civil Code. Since it is an acceptance by the hotel, the accommodation contract will be invalid and we will promptly notify you to that effect.

Special contract requiring no payment of application fee

Notwithstanding the provisions of Paragraph XNUMX of the preceding Article, the Hotel may enter into a special agreement that does not require payment of the application fee as stipulated in the same Paragraph after the conclusion of the contract.

If the hotel does not request the payment of the deposit as stipulated in paragraph XNUMX of the preceding article and does not specify the due date for payment of the deposit when accepting the application for accommodation reservation, it will be treated as if the special contract stipulated in the preceding paragraph has been accepted. increase.

Refusal to terminate the accommodation contract

Article XNUMX
The hotel may not accept the conclusion of an accommodation contract in the following cases.
(XNUMX) When the application for accommodation does not comply with these Terms and Conditions.
(XNUMX) When there is no room in the guest room due to full occupancy.
(XNUMX) When it is recognized that the person who intends to stay is likely to act contrary to the provisions of laws and regulations, public order or good morals regarding accommodation.Or when the same act is actually recognized.

D. When the person who intends to stay at the hotel behaves in a way that causes significant inconvenience to other guests.

(XNUMX) When accommodation cannot be provided due to natural disasters, facility failures, or other unavoidable reasons.

Guest Right to Cancel Contract

The guest may cancel the accommodation contract by notifying the hotel.

When the hotel has canceled the accommodation contract in accordance with the provisions of the preceding paragraph, the hotel will not charge the guest for the accommodation services, etc. that have not yet been provided.

Notwithstanding the provisions of the preceding paragraph, the hotel may allow the guest to use the guest room outside the hours stipulated in the same paragraph.In this case, the following additional charges will apply.

Liability of the hotel

Article 13:
The hotel will compensate the guest for any damages caused by the performance of the accommodation contract and related contracts, or the non-fulfillment of them.However, this does not apply when it is due to reasons not attributable to the hotel.

Handling when the contracted guest room is not available

When it is not possible to provide the contracted guest room due to various circumstances, we will arrange other accommodation facilities under the same conditions as much as possible with the consent of the guest.

Notwithstanding the provisions of the preceding paragraph, when other accommodations cannot be arranged, the hotel will pay the guest a compensation fee equivalent to the cancellation charges, and the compensation fee will be applied to the reparations.However, if there is no reason attributable to the hotel for not being able to provide the guest room, we will not pay the compensation fee.

Handling of deposited items

Article 15:

Article 17:

Guest Responsibility
