If the hotel accepts a special agreement within the scope of laws and customs, the special agreement shall take precedence regardless of the provisions of the preceding paragraph.

Application for accommodation contract

A person who intends to apply for an accommodation contract with the hotel shall notify the hotel of the following particulars:

In the event that the Guest requests, during his/her stay, the continuation of the accommodation beyond the date specified in Item XNUMX of the preceding Paragraph, the Hotel shall treat it as an application for a new Accommodation Contract at the time such request is made.

Establishment of accommodation contract, etc.

An accommodation contract shall be deemed to have been concluded when the hotel has accepted the application as stipulated in the preceding article.However, this does not apply when it is proved that the hotel did not accept it.In addition, when making a reservation via the Internet, when the fact that the hotel accepts the application set forth in the preceding article is displayed on the URL of the reservation reception site of the hotel (hereinafter referred to as this site) on the Internet, or It shall be established when the e-mail to that effect reaches the server that manages the e-mail address specified by the customer.

When an accommodation contract has been concluded in accordance with the provisions of the preceding paragraph, the application fee determined by the hotel up to the basic accommodation fee for the period of stay (XNUMX days if it exceeds XNUMX days) must be paid by the date specified by the hotel. .

The deposit shall first be applied to the final accommodation charge to be paid by the guest, and in the event of a situation requiring provision of the provisions of Article 18 and Article 12, the deposit shall be applied in the order of cancellation charges and then compensation. , If there is any remaining balance, it will be refunded at the time of payment of charges as stipulated in Article XNUMX.

If the application fee in Paragraph XNUMX is not paid by the date specified by the hotel in accordance with the provisions of the same paragraph, the accommodation contract will become invalid.However, this is limited to cases where the hotel notifies the guest to that effect when specifying the due date for payment of the deposit.

In the event that the Hotel presents an incorrect accommodation charge on the Internet site or informs of an incorrect accommodation charge over the phone, an application for an accommodation contract is made based on the said accommodation charge, and the Hotel accepts it, the said charge will not be refunded. If the price is remarkably lower than the accommodation charges for the preceding and following dates, unless the reason for the lower price is indicated or provided, such as "limited", "special", or "campaign", it is a mistake under the Civil Code. Since it is an acceptance by the hotel, the accommodation contract will be invalid and we will promptly notify you to that effect.

Special contract requiring no payment of application fee

Notwithstanding the provisions of Paragraph XNUMX of the preceding Article, the Hotel may enter into a special agreement that does not require payment of the application fee as stipulated in the same Paragraph after the conclusion of the contract.

If the hotel does not request the payment of the deposit as stipulated in paragraph XNUMX of the preceding article and does not specify the due date for payment of the deposit when accepting the application for accommodation reservation, it will be treated as if the special contract stipulated in the preceding paragraph has been accepted. increase.

Refusal to terminate the accommodation contract

The hotel may not accept the conclusion of an accommodation contract in the following cases.

Guest Right to Cancel Contract

The guest may cancel the accommodation contract by notifying the hotel.

If the guest cancels the accommodation contract in whole or in part due to reasons for which the guest is liable , except when the guest canceled the accommodation contract due to the payment.However, in the case where our hotel has accepted the special contract set forth in Article XNUMX, Paragraph XNUMX, when the guest cancels the accommodation contract, our hotel will not be responsible for the payment of the penalty when the guest cancels the accommodation contract. may be treated as unacceptable.

When the hotel has canceled the accommodation contract in accordance with the provisions of the preceding paragraph, the hotel will not charge the guest for the accommodation services, etc. that have not yet been provided.

Notwithstanding the provisions of the preceding paragraph, the hotel may allow the guest to use the guest room outside the hours stipulated in the same paragraph.In this case, the following additional charges will apply.

Accommodation charges shall be charged even if the guest voluntarily does not stay after the hotel has provided a guest room to the guest and it has become available for use.

Liability of the hotel

Article 13
The hotel will compensate the guest for any damages caused by the performance of the accommodation contract and related contracts, or the non-fulfillment of them.However, this does not apply when it is due to reasons not attributable to the hotel.

Handling when the contracted guest room is not available

When it is not possible to provide the contracted guest room due to various circumstances, we will arrange other accommodation facilities under the same conditions as much as possible with the consent of the guest.

Notwithstanding the provisions of the preceding paragraph, when other accommodations cannot be arranged, the hotel will pay the guest a compensation fee equivalent to the cancellation charges, and the compensation fee will be applied to the reparations.However, if there is no reason attributable to the hotel for not being able to provide the guest room, we will not pay the compensation fee.

Handling of deposited items

The hotel will compensate for the loss, breakage, or other damage to the goods, cash, and valuables deposited at the front desk by the guest, except in the case of force majeure.However, if you do not use the safe in the hotel or the safe in your room and lose cash valuables, the hotel will not be held responsible.Regarding cash and valuables, if the hotel asks for a statement of the type and value, but the guest does not do so, based on the recognition of the facts, we will comprehensively judge the various circumstances and We will compensate for the damage within the range of the reasonable limit.

Storage of guest's baggage or personal belongings

As mentioned above, this facility cannot accept any compensation for damages due to the handling up to the preceding paragraph.

parking liability

When a guest uses the hotel's parking lot, regardless of whether the vehicle key is entrusted to the hotel, the hotel only lends the space and is not responsible for the management of the vehicle.However, in the event that damage is caused intentionally or negligently on the part of the Hotel in managing the parking lot, the Hotel shall be responsible for compensation.

Guest Responsibility

When the hotel suffers damage due to the guest's intention or negligence, we will claim compensation for the damage equivalent to the guest.

Based on the revision of the Health Promotion Law, the entire building is non-smoking except for designated smoking areas and guest rooms where smoking is permitted.
If smoking is permitted in the hotel or non-smoking guest rooms other than the smoking area during the stay or after departure of the guest, we will claim damages (even after check-out) as a special cleaning fee and room charge for the sales suspension period. increase.
